Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these terms where such failure or delay results from circumstances beyond our reasonable control.

Such circumstances include, but are not limited to: natural disasters, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, epidemic, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

In the event of a force majeure event, our obligations under these terms will be suspended for the duration of the event, and we will use reasonable efforts to minimize the impact on our services.

Service Availability

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. About the service

The service lets you send a text message (SMS) to a phone number you enter. Messages are sent through our own phone and SIM gateway. The service is send-only: replies are not received by us or delivered to you. Free messages are queued for about 10 minutes before they are sent; a one-time paid option (about $2, paid through Stripe) sends instantly.

We do not guarantee that any message will be delivered, delivered on time or read. Delivery depends on carriers and networks outside our control, and we offer no service level agreement.

Your messages and responsible use

You are solely responsible for every message you send and for having the right to contact the recipient. In addition to the restrictions above, you must not use the service to:

• harass, threaten, stalk, bully or spread hate against anyone;
• send spam, bulk or marketing messages without the recipient’s consent;
• commit fraud, phishing or scams, or impersonate another person or organization;
• send messages as, or appearing to come from, someone else’s phone number;
• request or abuse one-time passcodes or verification codes;
• send illegal content;
• message people who have asked not to be contacted, including anyone who has used our opt-out page; or
• get around rate limits, bot checks or bans.

We may check, queue, refuse or block messages, ban users, numbers or devices, keep logs, and cooperate with law enforcement where the law requires it or where we believe it is necessary to protect people or our service.

Refunds

Payments are processed by Stripe and we do not store your card number. Paid purchases are final, except that if a paid message fails to send because of an error on our side, we will refund that purchase. To ask for a refund, contact us at contact@sendanonymoustextfree.com.
